Know your Weingarten Rights

If you are asked to participate in a discussion that you feel could potentially lead to disciplinary action, either for yourself or another employee, you have the right to have your union representation present.  These are your Weingarten Rights (1975 U.S. Supreme Court case NLRB vs. Weingarten, Inc. 420 U.S. 251, 88 LRRM 2689).

If you find yourself in this position, state the following:
If this discussion could in any way lead to my being disciplined or terminated, or affect my personal working conditions, I respectfully request that my union steward, representative, or officer be present at the meeting. Without representation, I choose not to answer any questions.

After this point, the meeting must pause until an EMU-AAUP representative arrives or be rescheduled for a time when both you and your EMU-AAUP representative can be present.  If you are asked to voluntarily forfeit your right to union representation, YOU SHOULD ALWAYS REFUSE.
